This talk discusses the potential implications of (neuro)scientific knowledge about emotions, socio-environmental factors, and moral behavior for the criteria of criminal responsibility and excuse. It further discusses the consequential impact of this body of empirical knowledge on penal theory and practice, including a shift in the rationale of punishment from retribution to social rehabilitation.
